Terms of Service

These Terms of Service ("Terms") govern your use of the Tottli website, iPhone app, Apple Watch features, widgets, and related services (collectively, the "Services"). The Services are provided by Westerby Labs LLC d/b/a Tottli ("Tottli," "we," "our," or "us"). By accessing or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to create or use a Tottli account.

2. Accounts And Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for activity under your account unless caused by our failure to protect the account.
• You must provide accurate information and keep it reasonably up to date.
• Notify us promptly at support@tottli.com if you believe your account was used without authorization.

3. License And Acceptable Use

Subject to these Terms, Tottli grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial caregiving and household coordination.

You agree not to misuse the Services, including by:

• Using them for unlawful, fraudulent, abusive, or harmful activity.
• Attempting to access systems, data, or accounts without authorization.
• Interfering with the integrity, performance, or security of the Services.
• Reverse engineering, scraping, or exploiting the Services except to the extent local law cannot lawfully prohibit it.

4. Your Content And Caregiver Sharing

You retain ownership of the content and data you submit, such as child profiles, activity logs, and household details. You grant us the rights needed to host, store, process, display, and transmit that data solely to operate and improve the Services.

Caregiver sharing inside Tottli is separate from Apple's Family Sharing. If you invite another caregiver, that person can see and use shared child data according to your in-app sharing choices.

5. Free And Paid Features

• Tottli offers a free tier and paid premium access.
• Paid options may include a monthly auto-renewable subscription, a yearly auto-renewable subscription, and a lifetime one-time purchase that is a non-consumable product, not a subscription.
• Displayed pricing, billing period, and any introductory offer are shown through Apple at the time of purchase.
• Monthly and yearly plans renew automatically unless canceled through Apple before the renewal date.
• Lifetime access is billed once and does not auto-renew.
• You can use the app's restore-purchases flow if you already bought access with the same Apple account.
• You can manage or cancel Apple subscriptions through Apple's subscription settings.

6. Apple Billing, Refunds, And Family Sharing

Apple handles App Store purchase processing, recurring renewals, cancellations, and refunds as applicable under Apple's rules. We do not directly process App Store payments.

Where Apple marks a Tottli product as eligible for Family Sharing, purchase access may be shared through your Apple family group under Apple's rules. Apple Family Sharing does not automatically share child data or caregiver access inside Tottli. Household sharing in Tottli is managed separately.

7. Third-Party Services

Tottli uses third-party services, including Supabase, RevenueCat, Apple, PostHog, and Sentry, to provide parts of the Services. Your use of those third-party services may also be subject to their own terms and policies.

8. Medical Disclaimer

Tottli is not a medical device, medical provider, or emergency service. The Services are for informational and organizational use only and do not provide medical advice, diagnosis, or treatment. See our Disclaimer for more detail.

9. Suspension, Termination, And Deletion

We may suspend or terminate access if you violate these Terms, create risk or harm, or if we discontinue the Services. You may stop using the Services at any time and may delete your account using the in-app deletion flow.

Deleting your Tottli account does not cancel Apple-billed subscriptions. Manage Apple billing separately through Apple.

10. Disclaimer Of Warranties

To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation Of Liability

To the fullest extent permitted by law, Tottli and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or goodwill arising from or related to the Services.

To the fullest extent permitted by law, Tottli's total liability for claims arising from the Services will not exceed the greater of (a) the total amount you paid to Tottli through the Services in the 12 months before the claim, or (b) US $100.

12. Governing Law And Venue

These Terms are governed by the laws of the State of Minnesota, excluding conflict-of-law rules. Subject to applicable law, disputes will be resolved in the state or federal courts located in Minnesota.

Nothing in these Terms limits mandatory consumer rights, remedies, or local-law protections that apply where you live. If local law lets you bring claims in your home jurisdiction or makes part of this section unenforceable, those rights continue to apply.

13. Changes To These Terms

We may update these Terms from time to time. If we do, we will post the updated version with a revised "Last Updated" date. Continued use of the Services after the updated Terms take effect means you accept them.
